HI,
I had my 1st H1B with a non exempt company for 1 yr then I joined a Exempt company (university) and they filed for my H1B. I am in my 8th yr of H1B with the university & recently got 3 yr H1B extension. If I want to change jobs to non exempt can I do the H1B transfer or do I have to apply a new H1B and will I be subjected to the quota restrictions.
Since I originally had H1B which was counted against a quota, couldn't the new non exempt company just transfer my H1B.
Any information is greatly appreciated.

I was on L1B and H1B for about 2.5 years around 2000-2003. I am now on TN for past 3-4 years and my current employer is going to chagne it to H1B.
The company HR and I are under the impression that this would require a new H1B application (by April 2nd to qualify for the upcoming year 2008 H1B quota). However, the company attorney told us that since I was on H1B in the past, so we don't need to file for a new H1B petition against the 2008 quota...rather we can activate my old H1-B at any time and use the remaining time from the 6 year period.
Does anyone know if there is any such provision to activate the old visa. I am under the impression that as I changed to TN status and no longer hold H1B, so it would require a new petition.
Your opinion would be appreciated.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. Can I Claim my sibling who is on F1 as dependent for TAX purpose ?

I spend 30mintes reading the Title V-Immigration benefit to get sense of this new immigration law.
I do not see a country cap (10%) anywhere in this bill?

Ask them to re-apply PERM as soon as possible.Its faster to re-apply then get the auditted PERM outcome...

My husband is on H1 and i am on H4. We recently got our EADs. What I want to know is, can i start working right away with my EAD while my husband works on H1 or are there any rules like my husband also needs should change his status from H1 to EAD so that I may use my EAD card?

You need to have an 1-485 application in at least for six months before using portability.
You can contact a body shopper and ask them to file I-140 and use your current priority date.
There is nothing else possible if you are already at your sixth year of H1B.

The D40 requires an AF-S lens as far as I know, I have never actually used one. I know it will work wit the D70. I recommend trying it out before buying it if that is possible. It works on the D70 by setting everything to manual. Good luck
