My parents-in-law visited the USA in the last week on B1/B2 visa. At the port of entry the immigration officer marked the expiration date on I-94 for my father-in-law for 6 months and however did not mark the expiry date on my mother-in-law�s I-94.
As they are visiting first time they did not know the procedure and they could not bought this to the immigration officer�s attention before they left ?
I assume they entered the expiry date in the system for my mother-in-law since both applications were processed at the same time with the same officer.
How this can be fixed ?
Is there any way I can call DHS and confirm the I-94 expiry date in the system ?

Hello,
In my LCA(H1B) Prevailing wage is $ 55K & in my Labor(PERM) application Prevailing wage is $ 65K.
My labor(PERM) has been approved & I-140 is in process at TSC.
My question is
This diffrence between LCA mentioned prevailing wage(i.e. $55K) & Labor(PERM) prevailing wage(i.e. $65K) going to create any problem at stage of I-140 or later in I-485??
I am getting paid as mentioned in LCA i.e. $55K.
I will greatly appreciate response.

Is there only one member in the IL chapter? I am sure we have several IV members from this state and nobody has responded. It is sad to see such response from members. IN order to get anything done, we all have to pitch in and help out.

I have no LUD at all for my 1-140 which was approved 6 months back. The status message still stays "...processing..." !!
So do not bother much about the online statuses and LUDs.

Hi,
My wife has a stamped H4 visa & I-94 both are valid through Oct 16th 2008. We have applied H1B for her which got approved somewhere in May 2007.
The Approved H1B documents along with new I-94 is with her employer.
We have some issues with the employer so we are not sure that we can get the H1B & I-94 documents from her employer.
As we also applied for EAD,In the mean time if we receive her EAD card and Travel Document for my wife.
Do we still need her H1B and new I-94 documents from her employer for any reason?
Any advise is well appreciated.

Hi,
Does 5% salary reduction require an amendment even though the salary is still much higher than the prevailing wage? I have been on a reduced salary for a year and about to get a visa stamp. Everybody says something different on this issue. I am just worried that this will cause problems in the consulate. I don't even know how the consular officers actually figure someones annual salary from their pay stubs. Should i just go and act like everything is normal and not mention about the reduction? Because it makes such a little difference in every paycheck. Please help me out on this issue. Nobody responded my previous post. I am very stressed out.

The ridiculous amount of time DOL is spending on the Perm Audits in just incomprehensible. They still approved 1 may be 2 application a day, thats my assumption. Last time I saw they are still processing audited-applications filed in Aug/Sept 2007.
Any word on how what their plan is? They really do have bunch inefficient people working for government!!!

I read an article on Automatic Revalidation.
It says if you have an expired visa, and a valid 797 you can still enter US.
Is it true for H1 extensions?

Any thoughts on transferring from BEC to PERM? I know that some folks in my company who applied recently with PERM got approval in less than a week!
I am wondering if anyone has already tried to transfer from BEC to PERM and what their experience has been?
I know that it is risky as it involves closing the pending case in BEC before opening a new one in PERM. The risk of losing the original PD is very high, especially for those of us with > 6years of H1.
DOL was supposed to get back with more clarification on the subject of transfer after gathering stakeholder comments but have not anything about it from DOL in months.

I was on H1.. but i quit my job and i am currently enrolled as a Full time student.
I need to go to Mexico as part of my Study program....
I have received the change of status from USCIS..but i need to get my passport stamped..
I have not been successful in getting an appointment in Canada....
>> Can i go to mexico and get the visa stamped during my stay there..is it risky???
>> i cam here on F1-h1-now back to F1.... do i have to go to my country of origin to get my visa stamped.

USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap.
