Hi, i have applied my labor application eb3 in 2003 august and got approveed, applied 140 and 485 in july 2007 and i am on EAD
i came to USA on Company A in august 2000 and moved to Company B on 2003 march and applied for green card in EB3
now my company A is willing to apply my gc in EB2 and capture EB3 pd
but my lawyer says if my EB2 gets rejected they may not issue my GC saying that my new job is not same or similar (he says eb3 job which does not require Master is not same as EB2 which requires Master or 5+ years exp)
Company A and Company B are belongs to same management so the compnay is ready to do my EB2, but my lawyer is telling there is lot of risk involved

I have the following questions with respect to number of days I can stay out of the country for my situation.
I have been on green card since June 2010.
I have visited India from October 17' 2010 to Feb 4' 2011 (Total 111 Days).
Now I need to go back to India again for around 3 months (Approx 10th May - 10th Aug) which is about 93 Days.
My questions are:
1. As a GC holder can I make the above visits without resetting my 'Continuity of 5 Yeard of Residence' clock ? As in each calender year I will not be out of country for greater than 180 days. But, when you count from October 16 2010 - October 15 2011, I will be more than 180 days out of the country.
2. If answer to the above question is NO, do I need to file/apply for any exception to be out of country?

Hi Guys,
A friend of mine from India is getting married to a US citizen here. She is coming here on a Fiancee visa (i believe K or V one of them). Does anyone know how long it takes to get a Green Card if you marry a Citizen?

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

Hi, I was wondering how long it is going to take me to get my citizenship. I received my permanent residency when I was 17. I was told I could have gotten my citizenship then but since I married a military personnel I wasn't sure if I was still eligible. Can I get my citizenship now because I received my "green card" under age or would I still have to wait 3 years being married to a U.S Citizen? Can I get my citizenship faster being married to a military personnel?

Hi All,
I have two questions as below:
1) My company announced that it was acquired by another company and the deal will be closed in early 2008.
My I140 priority date is Sept 21,2007 in EB2 in Texas SC. What should I be doing assuming my I140 will be approved in 6 months time, ie March 2008.
2)Also, my company is a Federal contractor working with the Federal organisation. All employees working for this contractor will always work for this Federal organisation no matter who the contractor is.In other words, the client remains same, but contractor changes.So if this Federal organisation gives this contract to any other comapny other than I am working with, how will my I140 processing be affected.

Did everybody who filed Jul 2nd at NSC got their reciepts?
seems like TSC is done entering Jul 2nd application as Jul 3rd-5th are getting their reciepts. It makes me wonder as to how the reciepts are issued if Jul 2nd filers are waiting and farther dates got their reciepts. Is it only issuing delay ?

Hello All,
My checks got deposited on Friday and when I checked my wife's I 485 status with the LIN # on the back of the check, it said that the finger printing fee was rejected and that the case is now in suspense.
It said that I have to submit a new fee and that the case will be resumed again.
Do you know why this happened. My bank statement says that the finger printing check for her got deposited.
So if there is a mistake in the check, would they still deposit it ? And would her EAD application get processed even if the finger printing fee is wrong ?
Did this happen for anyone ?

I need advise from gurus.
i have taken an appointment at the chennai consulate on aug 24th.
I have the old h1b approval valid till October 3 2006 to October 4 2007.
I have the new h1b approval valid till from october 5 2007 to october 4 2008.
I have taken the appointment for the new h1b approval. my question is:
since its valid from october 5 2007, can i come back to USA before october 5 2007? Do they give the visa stamp validity all the way from october 6 2006 to october 4 2008 since i have both the h1b approvals?
how does it work? we have to use only h1b approval? can somebody let me know they had the same situation?

You can get I-20 etc. But I think you will have to go to home country to get your F1 stamped. But better check with a lawyer.
