Today I received the update on uscis web site, saying that "Approval notice sent".

1. Applied on August 01 st (Vermont Service Center)
2. Receipt date Oct 2nd.
3. REF on Nov-26 for passport copies.
4. Responded to Ref on Nov-28, Sent passport copies on
5. Update in uscis web-site on 27-Dec-07 "approval notice sent"

Just in time for my travel.......

Don't forget the education is the biggest business in U.S.A and the immigration is the second one, thats what I learned from my 5 years experience. Both businesses dragging money from foreign ppl (International student has to pay 3-4 times more than local).

i sent all documents to loan officer at wells fargo for refinance. I sent I-140, EAD copy for immigration documents. just got email from loan office that he received my file back from underwriter and ask for greencard copy front and back as underwriter said EAD is not acceptable (Employer can not sponsor borrower).

could anybody please tell me what to do now?

Bank Of America denied my car loan. They want only US citizens or GC holders. I have EAD and apparently its not good at all for anything. I can't even get my drivers license. The DMV is waiting for a response from DHS, until then I have to find other means to go to work.

The other day at walmart, I paid my groceries, as usual with the credit card, so the walmart person wanted to see my ID. I showed her my EAD, she said she cannot accept that...she wants to see my Drivers License..I said it is expired and the only legal document with a photo ID is my EAD which is issued by the federal Gov...she was not convinces but said, "aahhh!!! thats okay, I trust you." and let me go...till the end she was not convinced in her mind.

Last I knew every H1 is a non-resident alien.

Well you knew wrong. As long as you stayed in the US for more than 183 days in 2007, you are a resident for tax purposes.

If you are falling short of the 183 day requirement, you can opt to fulfill the 183 day requirement by counting 1/2 of the days of the prior year (2006) or 1/3rd of the days of the year before that (2005) that you were physically present in the US.

Guys, please continue to leave voice messages, emailing & faxing those idiots at Atlanta PERM center who moved the staff to do other work like processing h2b cases. We need to be persistent if we need any positive outcome. Would those idiots who reassigned staff to do other work, now turn around and help us be reassigining more staff to clear the backlogs? We need to keep questioning them and bombard them with emails, fax and phone calls. It is very important that we act now, if not you all know how delicate of situation we are all finding ourselves in. Completely Agree with you. Rather have some process than none.People in the forum are talking a lot about visa recapture..

But how will this help if USCIS continues to disregard PDs utterly and just approve cases that they can lay their hands on....

Due to July 2 fiasco, pretty much everyone have filed I-485...Even those with 2007 PDs.

Say USCIS recaptures Visas, makes every category current and starts approving 2007 PD cases! Even worst, due to the every category 'C', may be 2008, 2009 (when it arrives) people start applying I-485 as well, and USCIS continues to consume all the visa numbers to to approve the cases of these lucky bas*$%^&ds (no offence!) with most recent PDs. How does this help you or me with older PDs waitin for years and years ! :(

even with recapture
- the visa numbers are not unlimited
- the processing power of USCIS is not unlimited

But
- The capability of USCIS to screw up at every opportunity seems to be unlimited
- And the number of lucky bas*$%^&ds who get approved despite newest PDs seem to be unlimited too :)

So , think visa recapture alone wont solve anything. We have to make USCIS accountable. Make them process cases fairly. Make them respect PDs.

This was directed to people who were current. If you are from India, China, Mexico, Philippines, get used to waiting. Your backlog is due to numerical limits. And this won't change (the way I see it)

Yes, it appears people on this forum are still confused about backlogs due to unavailable visa numbers and backlog due to CIS having too many 485s to process.

They are 2 different things.

Given the current market conditions,I dont think there will be a lot of new EB1,EB-2 ROW filings.Given that EB1 and EB2 ROW are current,there will be considerable overflow to EB2 I and C.The chances are very good that EB2 I and C will move faster than it moved late last year and early this year.April 2009 quarter opens new Visa Numbers too,If EB2 ROW and EB1 are slowed because of economy then certainly there should be some additional visa numbers available for EB2 I and C.At this stage it depends on PERM EB2 ROW data.

I think I am in a similar situation with you.Me and my kids are also separated from my wife for almost a year now. It was really a big mistake on my part not to join her on her Embassy interview thinking visas were plentiful.BIG MISTAKE. I was at that time not well informed about visa availability.Our PD is Nov 05 and I am from the Philippines. I do feel what you feel. It is an emotional roller coaster ride. Are you derivative beneficiaries of your wife's Sched A petition and what country are you from? If you dont mind me asking.

There could be lots of folks who missed July 07 fiasco. For the people who were able to file during July 07 that EAD is working as good as green card for now.. wish we could. Here is my case if that makes you feel little better that there are lots of people who missed the boat, I Had approved labor with PD Mar 06 and I-140 and i changed my Job in Mar 07 because of issues with desi company. I never imagined that dates will become current in just three months.. :mad:

Now i am still waiting for my labor.. I recently got three years H1b extension. This extension seems like green card to me :o


I share your pain buddy.I also miss the July 2007 fiasco by 1 month due to my &^@#$% lawyer who took 1 year to apply for labor and kept me in dark .The most painful thing is to see my wife's frustration who inspite of job offers can't join becoz company does not want to sponsor.Just being optimistic is the only hope.

it does say that H1B ext beyond 6 years can not be granted if there is not underlying pending process for GC (LC, 140 or 485).

However it does not talk about 'what happens if an ext is already granted'? so it still remains gray area. did I understand correctly?
