    Hello,

    After initially filing I-485, I got FP appointment for photo, signature and 10 fingerprints.
    Will I get another FP appointment notice ? When is it likely ?
    How many times do you get fingerprinted for one I-485 application ?
    Is there a validity date for FP ?

    It was really a proud moment for me and my wife to be part of rally yesterday. I felt really good that i am trying to do something about the situation. Hats off to aman kapoor and other core members who are putting their heart and sould into this fight even though they have their green cards already. As per the message conveyed in rally our real work begins now as we have to educate the congress members about the differance of legal and illegal immigration process. we should also try to involve as many members as possible who were not able to attend the rally due to their personal situation to be active in this education process. again salute to aman kapoor and core member team.

    Well seems like today both sides are going to blame each other for not having a bill today. Big question is - does discussions/negotiations re-start after the recess or is this issue pretty much dead. Most probably they will announce that they will re-start the discussion after vacation and provide the "most important legislation"...blabla... But what are the chances really? especially with new scandals beginning to take all the headlines. This is really frustrating and unfortunate. Lets see how the day goes.

    Our son was out of the country when we filed our 485 on July 2nd. Now he returned to US, how shall we file his AOS? Form I-485 or anything else? Shall we include a copy of our filing inside?

    In addition, the I140 was approved after we filed. And the principal applicant went out of the country and applied H1 visas and returned also.

    Shall we include the updated information of the principal inside or just the copy of the original filing?

    Attorneys please advice on my case below....

    I applied for an I-485 during July Fiasco under EB3 category with an approved I-140(EB3). EB3 priority date is October 2005.
    I also started another process later in EB2 category with same employer. My EB2 I-140 finally got approved recently and successfully porting the priority date from EB3 but did not file for I-485 in Eb2 yet.

    Last week, my EB3 I-485 petition got approved even though my EB3 prority date is not current. I have got my welcome letter (I-797C) today. The COA is 26 on the notice.

    My questions are:


    Is it approved by error?



    What are the risks involved for now and down the road.



    Can we travel outside United States using this GC.


    Will appreciate any advice.

    The "A" number eventually becomes your GC number. It is not necessarily the Visa Number...we don't get to see the Visa Number.

    My sister is in US in Visitor Visa with I-94 expiration date of Nov 25th 2009. We would like to convert her status from B2 to F1 Visa ASAP.

    1) Do you know anyone who has changed the status from B2 and F1? If yes, can you share the experience?
    2) Is it risky to do that? What kinds of problem we may encounter?
    3) Can she stay in US while F1 is pending? what happens if rejection shows up after her current i-94 expiration date?
    4) Is it better to go home country and apply for the F1 Visa or it is safer to change the the status in US.

    Any advise you can throw will be appreciated.

    My wife will be relocating to Toronto,Canada for work and I will be traveling between the US and Canada. My employer is fine with me telecommuting 50% of the time which means I will be working 2 weeks remote and 2 in the USA for the next one year. I will continue to be a US FTE [Software Development] and also pay US taxes. Will I be able to continue being on H1B status while I travel or do I have to explore other visa options? Since I will be returning to the US every 20 days [and by road] will I be able to use the automatic I94 revalidation?

    I know for a fact that you cannot count current employer exp for GC. If i start working for the same employer on XYZ is it more than 50% different in role so i can count my 3 years experience when applying my GC ??

    hI ATTY I am working under an h1b visa right now as of 2011. But i had a previous petitioned by another employer way back 2006. There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case??     Hi guys,

    I am adding my wife's AOS application to my own pending AOS application. Because of whatever reasons we couldn't file our apps together earlier.

    I notice that I need to give my wife's Alien registration no (ARN) at a couple of places in the application package, such as in the I-485 form, G-325A form, and at the back of the photographs.

    Needless to say, my wife does not have an ARN. I was allocated an ARN when my I-140 got approved. Since she is just a derivative beneficiary, she does not have an ARN yet.

    So what should I do about these columns in the form. Should I leave them blank, or should I fill them up with my own ARN.

    Hello gurus..

    I filed for my H4 extn on Jan 16th(Cal Serv Centre)..I dont think so I can get the H4 approval extn by April 1st... other than the option of getting it done in premium processing ... can I file for my H1 in April before my H4 approval comes..?

    All in all I will need atleast 5k for my H1 and in case if I have to get my H4extn premium processed..

    My application was filed in EB3 category and PD is current (has been since start of this year). I have an approved I-140 since Feb 07 and the I-485 was filed prior to the mess of 2007. I have taken 4 Infopass appointments trying to find out why is it taking this long to get "a decision". At this point, I don't care what the decision is, as long as there is one so that I can move on in my life. Called and spoke with the processing center that the case is outside their "normal processing time" only to hear, "We are processing". They won't tell me what is going on.

    Wondering about my options here? Congressional inquiry? Writ of Mandamus? Anything? Anyone in the same position as me?

    I went for Fingerprinting for I-485 case seond time on 9th May. When it is updated in your profile at uscis website. I see it is still showing up old dates as LUD.
    Any idea ?

    I gave my Fingerprints also. So far i did not see any LUD. I dont know what they are doing. Simply ignore it. There is nothing to do ourside.

    Just a thought.. maybe some experts can help..

    Does BEC Capture the following information at the time of entering data..

    Type of application � Eb2, 3 or Other workers category..
    Nationality of application..

    My understanding is that BEC does not determine the EB2 or EB3 until the final stage, nor is the nationality captured as part of the older labor process (I could be wrong.).. and if the nationality is captured then an application of an Indian can only be substituted by an Indian???

    In case they don�t,,, how can DOS determine the all the 245(i) applications at the BEC are Eb2.. or Eb3.. or for that matter from India. On an optimistic side.. when all the cases at the BEC get cleared in June 07 and DOS realizes that bulk of the cases were for Other Workers Category .. may dates for EB2 and EB3 could make huge movement forward then..

    Just want to know my options here and here is my scenario:

    I am on H1-B and my 6 years of H1B is going to complete on March so I have almost 1 more year to complete my 6 years of h1-B
    Right now, I have my LC and I-140 approved from my present employer.
    Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
    My question is:
    If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
    I don't have the copy of my I-140 but I think I can get it.

    I had received FP notice 2 days ago and my FP date is after 3 weeks. I was getting ready to try to do it early but I just received Card Production Ordered email for both my spouse and myself. What do I do now? Do I need to still go for the FP after 3 weeks.

    I am not sure why they would send me the FP notice if they wanted to approve my GC.

    Whatever you call it, you are really always applying for a new EAD. There is no such thing as renewing an existing EAD. The I-765 form that you complete will ask about any prior EADs that you had. If you do not have details, please put as close to the facts as possible. If you still have a CIS receipt number, definitely include that so CIS can look up the details.

    On mar 12th I got a query on I-485.
    It says.

    The Documentation submitted with your application and/or a review of service records indicate that you no longer reside in the same state or geographical location as the underlying form i-140 immigration petitioner and /or job location specified by your intended permanent employer.

    There fore submit a currently dated letter from your original form I-140 employer which which address this discrepancy.

    I filed my labor and I-140 I was in california, i moved to different state since I filed my 485, till now I am with the same employer.

    Any gurus who can suggest me on the query would be greatly appreciated.

The chief source of all this animosity and gridlock is the Democrats' intentional strategy to pursue partisan votes on Iraq to pressure the administration and embarrass vulnerable Republican Senators. The predictable side effects have been to poison the well for other legislation and exacerbate already frayed inter-party relationships.

    The frustration experienced by Senate Majority Leaders is nothing new and has been amply expressed by former Leaders of both parties. The job has been likened to "herding cats" and "trying to put bullfrogs in a wheelbarrow." But there does seem to be a degree of difference in this Congress for a variety of reasons.

    While Iraq certainly is the major factor, the newness of Reid on the job is another. It takes time to get a feel for the wheel. Meanwhile, there will be jerky veers into the ditch. Moreover, McConnell also is new to his job as Minority Leader. So both Leaders are groping for a rock shelf on which to build a workable relationship. Add to this the resistance from the White House at every turn and you have the perfect ice storm.

    Reid's big complaint has been the multitude of amendments that slow down work on most bills - especially non-germane amendments - and the way the Senate skips back and forth on amendments with no logical sequence. These patterns and complaints also are not new, but they are a growing obstacle to the orderly management of Senate business.

    Reid has asked Rules and Administration Chairwoman Dianne Feinstein (D-Calif.) to look into expanding the germaneness rule. The existing rule applies only to general appropriations bills, post-cloture amendments and certain budget matters. The committee previously looked at broadening the germaneness rule back in 1988 and recommended an "extraordinary" majority vote (West Virginia Democratic Sen. Robert Byrd suggested three-fifths) for applying a germaneness test on specified bills. But the Senate never considered the change.

    The House, by contrast, adopted a germaneness rule in the first Congress on April 7, 1789, drawn directly from a rule invented on the fly and out of desperation by the Continental Congress: "No motion or proposition on a subject different from that under consideration shall be admitted under color of amendment." According to a footnote in the House manual, the rule "introduced a principle not then known to the general parliamentary law, but of high value in the procedure of the House." The Senate chose to remain willfully and blissfully ignorant of the innovation - at least until necessity forced it to apply a germaneness test to appropriations amendments beginning in 1877.

    Reid's suggestion to extend the rule to other matters sounds reasonable enough but is bound to meet bipartisan resistance. Any attempt to alter traditional ways in "the upper house" is viewed by many Senators as destructive of the institution. The worst slur is, "You're trying to make the Senate more like the House." Already, Reid's futile attempts to impose restrictive unanimous consent agreements that shut out most, if not all, amendments on important bills are mocked as tantamount to being a one-man House Rules Committee.

    What are the chances of the Senate applying a germaneness rule to all floor amendments? History and common sense tell us they are somewhere between nil and none. Senators have little incentive to give up their freedom to offer whatever amendments they want, whenever they want. Others cite high public disapproval ratings of Congress as an imperative for reform. However, there is no evidence the public gives a hoot about non-germane amendments. Only if such amendments are tied directly to blocking urgently needed legislation might public ire be aroused sufficiently to bring pressure for change; and that case has yet to be made.

    Nevertheless, the Majority Leader's lament should not be dismissed out of hand. It may well be time for the Senate to undergo another self-examination through public hearings in Feinstein's committee. When Sen. Trent Lott (R-Miss.) chaired that committee in the previous two Congresses, he showed a willingness to publicly air, and even sponsor, suggested changes in Senate rules. One such idea, to make secret "holds" public, has just been adopted as part of the lobby reform bill.

    The ultimate barrier to any change in Senate rules is the super-majority needed to end a filibuster. Although, in 1975, the Senate reduced the number of votes required for cloture on most matters from two-thirds of those present and voting to three-fifths of the membership (60), they left the two-thirds threshold in place for ending debates on rules changes. That means an extraordinary bipartisan consensus is necessary for any significant reform. In the present climate that's as likely as melting the polar ice caps. Then again ...

    I had L1A from 10/2005 to 10/2008. My lawyer filed I-485 in 2008, but he did not file extension of L1A. My L1A is expired in 2008. In Jan. 2010, my I-485 was denied. We filed appeal in Feb.. Then, we filed L1A extension, which is denied in June 2010. I do not know what to do? I have been in here for five years. now my wife and child's L2 also expired. Can I file another L1A without leaving USA (I was told no, because I did not meet 1/3 requirement, one year abroad within three years of admission into the USA. I have to go back Jamaca for one year and refile there, but I would give up my I-485). Thanks.
