Hi,
My labour and I40 are approved and PD is 12/07 for EB2.
My H1B 6th year expires on 10/10
I am thinking of changing companies. The job will be the same.
My questions are:
1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

Unless some political goof up turns, economy seems to be getting brighter and brighter. This might help translate into more jobs and opportunities..

Hi -
I got my I-140 approved back in 2008 and last year my H1b was extended for another 3 years.
I am planning to change job now and once the new company transfers my H1b will it be extended for another 3 years or for the remaining duration of my current H1B.
Also what happens if my current employer revoke the I-140 after i change job?
Until when can i start the GC process with new company so that i don't go out of status and keep getting extensions until i get my GC?

Hello All,
I will be appearing for L1 individual visa extension in chennai in a few days from now.
One the questions that would be asked by the VO would be "where and who do you work for". The second part is easy since i work for the petitioning employer rendering my services for their client. However for the first part of the question what appropriate answer can be given?
Can i mention the client name location in US since that is where i currently work although i am controlled by the petitioning employer. I would not be working from the petitioning employer work location in US. I believe the L1 Visa reform act of June 2005, tells that you can work from offsite location provided you are controlled/managed by petitioner.
Please advise as it would help me in responding with correct answer. Thanks.

My lawyer got an education evaluation done and filed an appeal withing 30 days , in January 2008. The appeal has been pending since then.
I need advise on what to do next? Should I apply for another I-140? Can I somehow get the appeal decision expedited?
