I guess no complications unless USCIS asks for employment verification at the time of approving the case. He should continue to file for Income tax retrun for 2010 and also need to work for few months in 2011 to file for return.

Considering many limitations to move a job from non-profit to for-profit, I am considering moving my job to another non profit. With my current employer, my 6 year H-1 B will expire by the end of next year April. So if my change my employer, I will have a very short time to start the process again till I reach I -140 approval again with the new employer.
I heard that from non-profit to for-profit, you are subject to the quota and you have to apply for H-1B quota. But in this case, your previous 6 year with non profit doesn't count.
But if I move from non-profit to non-profit, do I have to reach I-140 approval before my current H-1 B with my current employer expires? Or do I just get another 3 year with new non-profit employer?
If I have to get I-140 approval with new non-profit employer before my current 6 year H-1 B expires, is it doable?

I was working with company A and got approved I140(1 year back) after that I moved to company B using approved I140 and got 3 yrs H1B extension.After that during July,07 period I requested company A to apply EAD and i485(Company A mentioned as future employment).Now I am still with company B.
But now Company A asking me to come back.Since I have everything approved (i140) except i485(pending) do I need to go back to company A?
If I do not go to company A,can he cancel approved I140 ?
Need help/suggestion .

i recently got H1 Extension stamping ( Till 2011 ) and also have AP Expires in Nov 2008 .
I am working on H1 and not interested to use EAD .Do i still need to renew my EAD and AP?

just a tip not cool to hijack someone else' thread. on your question: If you are planning on being with the H1 sponsoring employer for the next few years no point renewing your EAD or AP. However they are two seperate filings. You don't need to have a valid EAD in order to apply for an AP renewal or vice versa. Hope this helps.

Hi Ron,
We all appriciate your support and help. My citizen mother has filed the immigation petition under F1 category. Currenty I am in US on H1B. Priority dates are near and I am palnning to file AOS. Category F1 is Child of unmarried son of US citizen.
The LCA and Petition papers used for the my H1 Visa (at consulate interview) has the Job Title Programmer I. But before coming to USA I got reassigned and I got a new LCA from the company (I got new LCA in India itself). Recently I looked into that New LCA it has recorded my Job Title as Programmer II. I am working on this new LCA location.
I have following question.
Does this Probrammer I/ Probrammer II change in LCAs affects my AOS for my family based category F1. (AOS H1 -> F1 Family based)

OED defines Visa as "An endorsement on a passport indicating that the holder is allowed to enter, leave or stay for a specified period of time in a country"
By that definition I believe that a visa can be issue anywhere, inside and outside of the country.

I am currently working on H1B1 � and my visa is valid till May 2009. The visa on passport (from last employer) is valid till March 2008. We applied for green card through my spouse�s company � our I485 has been applied (His H1B1 is valid till Mar 2008). We both got our Advance Paroles, and he got his EAD � about 5 weeks ago. Though my EAD was also requested at the same time, I have not received mine as yet.
Due to my husband�s job we are moving to another city in November. I plan to resign from my job at the end of November, and go for 6 week vacation to India. I plan to look for a new job (hopefully on with my EAD) when I get back in January 2008. I have following questions:
1. Now when I resign & my H1B1 gets cancelled, what would be my status in USA.
2. Do I need to get back to H4 status to come back to US (or just AP would be enough for POE)
3. Do I need to get back to H4 status to stay in US

I have got 2 I-140 (one pending and approved) both from different lawyers.....I applied 485 with my approved I-140 with this lawyer, but am not sure if he has applied or not as he had given wrong info few times before...... he claims he has applied.........my question is - Can I go ahead and apply another 485 with the pending I-140 frm another lawyer to be on the same side? I plan to withdraw one once I receive both receipts.....Any risks?

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..
They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.
so should i come to new program..if thats the case how to get an emergency appoitment.

I also received RFE. It was related to TB chest X-ray. In '07 doctor said, it is not requited but USCIS feels other way.
