Hi,
Following are my USA stay details on L1 and H1-B visa:-
1) Stayed in USA from 01-SEP-2003 till 25-JAN-2004 on L1 visa(expired now).
2) Stayed in India from 26-JAN-2004 till 01-NOV-2004.
3) Stayed in USA from 02-NOV-2004 till date on new H1-B visa(still valid).
I read somewhere that 6 year period for H1 also counts L1 stay. Can someone please suggest, what should be my H1's final expiry date based on above details? Will that L1 stay be counted, even though I went back to India and came on a new H1-B visa?

You should bring evidence of your strong ties to the country where you live now - evidence of a job, family, house, club memberships, bank accounts, etc. Anything you can think of that would show an immigration officer that you really intend to return home at the end of this trip.

Hi all,
I had my h1 issued in nov '09 and was laid off from the company in march '10. However, I was able to secure other position in the same company a month later. But now the company wants me to exit/re-enter the country (and get my visa stamped) before starting the new position.
Since I was technically out of status for the month of April (and don't have any paystubs for the same), will it be difficult to get my h1 visa stamped? Also, can I get my stamping done in Canada, or will I have to my home country?

You need to have an 1-485 application in at least for six months before using portability.
You can contact a body shopper and ask them to file I-140 and use your current priority date.
There is nothing else possible if you are already at your sixth year of H1B.

Does the I-485 filing date matter? i.e. If one person files their application on July 1st and the other files on say July 25th (due to some reasons), will their I-485's get processed in FIFO?

Friends,
I came to USA on H1B on Feb-07. I was working all the time except 6 months. I have pay slips with me and W2 forms. Now I am working on the project but it will be over on 15th of April-09.
I will complete my 3 years. But after this project is over, I don't know I can find the job again.
My question is,is it right time to do the visa transfer? Does it requires very recent pay stub of 3 months? I do not have pay stub for Jan and Feb-09.Does it matters?
What will be my best choice to transfer the visa(but don't know will have job after 15th so does it matters for transfer like client letter) or wait until May-June and file the 3 year extension ? But again that time I will have pay slips until April only.
I am really confused. Please give me your suggestions

When a particular priority date becomes current in the next month's bulletin,say the July bulletin. Does USCIS start looking at the current cases once the July bulletin is issued or starts looking at them from July 1st.

My I-140 was denied by TSC early last year. We sent in an MTR/Appeal on the denial. The case was sent over by the TSC to AAO. We received an RFE from the AAO on the appeal a couple of months back. We responded back to the RFE within the required time frame.
My attorney just informed me this week that the case has been transferred back to the USCIS from the AAO. Can anyone please tell me if this means that my case has been approved or denied? Also how long can the USCIS sit on it before adjudicating? I'm assuming that the AAO has passed a decision, thats why they have sent it back to USCIS....
PLEASE HELP!!!

What is the impact on GC (485 application) approval for a minor Customs violation at the airport?.
I unintentionally ignored to declare some food that i was bringing and airport customs officer fined me $300.
Will this impact my 485 application, that i will be filing soon?.

If you call USCIS 1800 number, and you ask the representative to raise a service request then they email the service center asking for details. Most of the time, personnel from service center will call back with the information that you have requested. If you learn there is a way you can email the service center, please post here.
