    House Democrats Try Softening Their Tone; Lawmakers Seek Republican Votes Amid Veto Threats (http://online.wsj.com/public/article/SB119491416890790655.html) By David Rogers | Wall Street Journal, Nov 13, 2007

    WASHINGTON -- Down in the polls, House Democrats are showing a little more finesse as they try to move their legislative agenda around the wall of veto threats thrown up by President Bush.

    Cute is out; conciliation is in. Late-night talks with Republican moderates intensified last week on the Democrats' signature health- care initiative -- extending coverage to millions of working class children. Staff negotiations continued during the holiday weekend, and Georgia Rep. Nathan Deal, a Democrat-turned-Republican with expertise on health and welfare issues, has been invited in by both sides as a broker.

    House Appropriations Committee Chairman David Obey (D., Wis.) last week abandoned a confrontational plan to pair defense and education budgets, which would have dared the president to veto both. Instead the two bills were sent separately to Mr. Bush, who could veto the education measure as early as today. Looking ahead to the override vote, Mr. Obey took care to preserve House Republican provisions regarding abortion, child vaccines and abstinence education.

    The House is scheduled Thursday to take up an antipredatory lending bill that is a showcase of cooperation between the chairman of the House Financial Services Committee, Rep. Barney Frank (D., Mass.) and his ranking Republican, Rep. Spencer Bachus of Alabama.

    "He called up and said why don't you come down to my office and tell me what you need to be on the bill," said Rep. Steve LaTourette (R., Ohio) of his own dealings with the chairman. Mr. Frank is a close ally of House Speaker Nancy Pelosi and has urged Democrats to permit more Republican amendments as a way to change the political tone in the House.

    "It's transactional -- you have to see what it brings," Mr. Frank said. "But Hubert Humphrey once said, 'Whenever I get cute, I blow it.' That's the same thing I'm saying: if you try to be too political there's a backlash."

    That backlash is evident: Congress's approval rating has fallen from 31% in March to 19% this month in the latest Wall Street Journal/NBC News poll.

    A year after returning to power, House Democrats are at a crossroads. The party's early agenda -- tougher ethics rules, a minimum-wage increase and more aid for college students -- is largely in place. To go further, the majority must overcome not just presidential vetoes but the often-crippling partisan bitterness left from 12 years under Republican rule.

    The war in Iraq, which permeates Washington and again divides the House this week, makes that cooperation harder. As the president lays down vetoes, he seems to prefer a divided Congress that poses less of a challenge. And the Senate's filibuster rules, which require a 60- vote supermajority just to get a bill to the White House, are an added frustration for House Democrats.

    Allies of Ms. Pelosi said she could do more to take the lead and soften the tone in the House by using her power over the Rules Committee to allow more Republican amendments.

    Last month's floor fight over the Foreign Intelligence Surveillance Act -- a controversial arena relating to the government's wiretapping activities -- is a case in point. The Rules panel disallowed all 27 Republican amendments. The minority retaliated with a procedural motion that successfully forced the bill to be withdrawn, and it still hasn't come back up for debate.

    Ms. Pelosi's combative nature doesn't make such a shift easy. When the president recently accused Democrats of being led from the left by the anti-war group Code Pink, she saw it as a slight on her and responded in kind, saying Mr. Bush was acting less like "the president of the United States" than a "a junkyard dog on television every day because he has nothing to produce."

    Going into 2008, the Californian said her party is well positioned on the issues most important to voters. Democrats think the child health-care fight is a long-term winner with bipartisan appeal. Party polls show her next priority, an energy bill that demands that cars be more fuel efficient, would appeal to independent voters. And tougher safety standards for imports from China is a third bipartisan issue that Democrats hope will improve Congress's image and is a reminder of Ms. Pelosi's early human-rights record on China.

    "Nothing is a setback, we're going forward," she said, sitting in her Capitol office.

    Ms. Pelosi's tough style borrows from her hero: the late Speaker Thomas "Tip" O'Neill of Massachusetts. Another Boston politician, and an O'Neill ally, Joseph Moakley, may be more relevant in Ms. Pelosi's predicament.

    Mr. Moakley, a former chairman and long-time fixture in the House Rules Committee, lived by the maxim that he was in power to "say yes, not no."

    "I always thought real power was the ability to say yes," Mr. Moakley said months before his death in 2001. "Because when I'd say yes, I found out they'd usually say yes back to me."

    Opponents of Arizona's SB1070 immigration law scored another victory in the courts yesterday. In the case of Friendly House v. Whiting, the court overruled a motion to dismiss the case challenging the law. The judge noted that "Racial discrimination was a motivating factor for [S.B.] 1070�s enactment" which establishes a legitimate constitutional challenge to the law. While this is only the opening round in the case, it does suggest that the defenders of the law will have a tough time convincing the judge that the law is constitutional. 10-1061-447 -

    I got labor cert approve on FEB10 and going to apply I-140 via preium process in Mar 15.
    My Laber cert was file on April 09 and I have been paid lower than prevailing wage since the company reduce working hour and aset of company is 0

    Year 2008
    W2 + Net income tax return of company reach required wage
    Year 2009
    W2 + ballance sheet reach required wage (but net income tax return for 2009 is not availble yet)
    Are they going to ask for 2009 net income tax return in March? if my company going to file tax extension this year and I also afraid that the net income in tax return may be lower than the number in balance sheet this year.
    Is it posible that My case would be get approve without any RFE?

    Hello everyone,

    My questions are about F1 to H1b change status.

    I applied an H1b through a consultant company on April 2008. I received a notice from USCIS told me had been lottery H1b. However, until now my case is still pending. My OPT expired on Jan, 2009 and can't be extended. I am in the middle of the 60 days grace period right now. My questions are:

    1. If the 60 days expire and my case is still pending, can I legally stay in US till H1b approved?

    2. If my H1b is rejected and the 60 days expire, how many legally days can I stay in US? Do I have another 30 grace period days?

    3. In my situation, what should I do right now? Do I need to find a school to keep my F1 visa? When is the best time to find a school?

    4. Can I transfer H1b to another company during my H1b is pending?

    I am very appreciate if you can answer these questions. :)

    I applied EAD for me and my wife, yesterday.
    When I check for the case status, it shows my wife EAD application as I131(advance parole) document.

    XXXXXXXXXXXX Y N 08/26/2010 I131 APPLICATION FOR USCIS TRAVEL DOCUMENT

    I have complete I765 application with receipt still I guess I need to call them.
    Is anyone in the similar scenarios?

    Hi,

    I have my labor certiifcation approved and currently filed for I-140.
    I-140 is not approved yet.
    I have an offer from another employer with very similar job profile.
    My 6 yrs of H1 is getting over in 2010 summer.
    My prioriy date is Dec/07.

    What are my options
    1) Can i change a job and keep same priority date(as job profile is very similar)
    2) Do I have to start from zero again?If yes,how much time I have to get priority date assigned again(considering my H1 bgets over in 2010 summer?)

    My parents are planning to apply for visitor visa. My aunt (dad's sister) has applied a immigrant petition for him about 4 years back and it is still in process. If my dad applies for a visitor visa which is non-immigrant intent, will he face any issues with issuance of visitor visa ?

    Robert Creamer has an interesting analysis of how the ruling in Arizona could affect the Democrats' prospects in November. Many pundits are assuming that Republicans benefit. But Creamer makes a point I've said here many times. The only voters who switch their votes on the immigration issue are Hispanics. Anti-immigrants NEVER vote for the Democrats anyway. They almost always have a host of issues that they care about and in most cases the GOP is the better fit for those voters. So Democrats who try and pander to the Tea Party types are wasting their time.

    Could anyone share their experience/knowledge about getting home loan on EAD? My bank says that, for non-FHA loans, you need to be in any of the visa categories like H1, TN1, GC, ... But its list doesn't include EAD or Adjustment of Status. Can that list be challenged to include EAD? That is, how to convince the bank/lending inst that EAD is a legal/legitimate status like H1?

    Hi,
    I'm on F1 visa and recently got married in US..I would like to have my lastname changed in my INDIAN passport.. I will apply for a new INDIAN passport through indian embassy in US..I realized that i will get a new passport with new last name...But my question is what happens to the F1 visa on the old passport and I-94, will they be still valid?...How does it work..what do i need to get them moved over to the new passport...
    I know i will have to let my school know about the name change so that they can get me a new I-20 by updating the SEVIS...I've already done that and they are OK with it...

    I am sure that IV core team organizes events and actions pretty well. I know there are usually action items that get posted on IV.

    How about thinking about the action items in a different perspective. For any event/action, create a task force. Ofcourse that may have been what is done as of now. But all am saying is create a taskforce every action/event to be organized at different levels vi.z, IV Core, IV State, IV Local and create a menu item called TaskForce on the main page. Anyone who is interested in a particular event or action would get in touch with the taskforce team.

    Not sure if it makes sense but just a thought of coining a different name for the action items with assigned roles and ability to contact easily.

    WASHINGTON, May 18 � Hours before a bipartisan deal on immigration policy was to be announced Thursday, a tenuous compromise was threatening to unravel, and tempers flared once again.

    Just off the Senate floor, Senators John McCain of Arizona and John Cornyn of Texas, both Republicans, exchanged sharp words, with Mr. McCain accusing his colleague of raising arcane legal issues to scuttle the deal. Mr. Cornyn retorted that he was entitled to his view and noted that Mr. McCain had spent more time campaigning for president than negotiating in recent weeks.

    The senatorial dust-up, described by witnesses, was just one of the tense moments in remarkable negotiations over the last three months that resulted in this week�s accord. Senator Arlen Specter, the Pennsylvania Republican who oversaw the talks, compared them to a floating craps game, with a changing cast of characters and shifting sites.

    Lawmakers and staff members who participated said passions occasionally ran high in the dozens of meetings, with Senator Edward M. Kennedy, Democrat of Massachusetts, sometimes using his temper as a negotiating tactic. Senators who had spent hours anguishing over the smallest details had little patience for colleagues who made brief appearances to offer their views.

    �New people came in and wanted to revisit the whole deal,� Mr. Specter said. �That happened all the time. It was very frustrating.�

    In the end, negotiators overcame political divisions and some level of distrust to produce the agreement that will be debated in the Senate beginning next week. Lawmakers said they forged bonds partly through the telling of personal stories about their own family roots, as well as long hours spent together and the prospect that the bill might be a last chance at reaching consensus on a major national problem.

    �It was like waiting for a baby to be born,� said Senator Lindsey Graham, Republican of South Carolina, about the negotiations. �On occasion, it was like being in mediation with a divorced couple. It was like being at camp with your buddies. It was feeling like a part of history.�

    As difficult as the negotiations were, they might ultimately seem tame compared with the fight the authors of the plan now face. Before the language of the bill was even published, the proposal � a major domestic objective of the Bush administration � was under attack from the right for allowing illegal immigrants to earn citizenship and from the left for dividing families. The offices of the negotiators were under siege from critics who had the phones ringing endlessly.

    �It is real easy to demagogue this thing, and some people probably won�t be able to help themselves,� said Senator Mel Martinez, Republican of Florida and another key participant in the talks. �We are going to have to stick together on the fundamentals of this agreement.�

    The talks had their genesis in last year�s failure on immigration after House Republicans essentially chose to ignore a bill passed by the Senate that conservatives derided as amnesty since it would have allowed some of the 12 million illegal immigrants in the United States to remain and eventually qualify to be citizens.

    President Bush helped plant the seeds of this year�s negotiations on Jan. 8, at a White House event celebrating the fifth anniversary of the No Child Left Behind Act. Mr. Bush pulled aside Senator Kennedy, and they went into a room off the Oval Office to talk about immigration.

    A month later, Senator Jon Kyl, a conservative Republican from Arizona who would become an important figure in striking the deal, began meeting with other Republicans and administration officials to explore ways to find a legislative response to an issue with potent political and humanitarian ramifications.

    When those talks progressed far enough, the Republicans on March 28 invited in Democrats like Mr. Kennedy, a longtime advocate of immigration changes, and Senators Ken Salazar of Colorado and Robert Menendez of New Jersey. What followed was a series of meetings around the Capitol, typically on Tuesday, Wednesday and Thursday nights, as the lawmakers, staff members, White House officials and two or three cabinet secretaries immersed themselves in immigration rules as part of unusually direct high-level negotiations.

    �To take an issue and basically start from scratch and write it from the bottom up is something I haven�t seen done in a really long time,� said Candida Wolff, chief of Congressional relations for the White House.

    The first big hurdle was cleared a few weeks ago when the negotiators settled on what they called the grand bargain, the main outlines of the issues they were going to address. Major elements included border security improvements and other measures that would have to be undertaken before new citizenship programs were put in place; potential legal status for millions of illegal immigrants; new visas for hundreds of thousands of temporary workers; and clearing a backlog of family applicants for residency.

    Republicans also won support for a new �merit-based system of immigration,� which would give more weight to job skills and education and less to family ties. The negotiators decided to adopt a point system to evaluate the qualifications of foreign citizens seeking permission to immigrate to the United States.

    No question was too small for the senators. They asked: How many points should be awarded to a refrigerator mechanic with a certificate from a community college?

    The negotiations were a roller coaster ride that continued until the deal was announced Thursday, with negotiators expressing despair one day and optimism the next.

    �Wednesday evening was one of the most important moments,� Mr. Kennedy said in an interview. �The mood and the atmosphere were good. You got a feeling that maybe this would all be possible. But on Thursday morning, it suddenly deteriorated again.� He told his colleagues that �it�s imperative that we announce an agreement� on Thursday afternoon, or else they could lose momentum. The announcement was made.

    In some respects, the lawmakers benefited from the Congressional focus on the Iraq war as they were able to negotiate below the radar, avoiding the disclosure of every twist and turn in the talks and pressure from influential interest groups. Those involved also said the deep participation of Homeland Security Secretary Michael Chertoff was vital.

    The senators who put together the bill say they have their own reservations about aspects of it. And some of the regular participants, including Senators Cornyn and Menendez, have backed away from endorsing it. But those who have embraced the bill say they intend to see it through.

    �We made a pact,� said Mr. Specter, who was referred to as Mr. Chairman even though Democrats control Congress. �We will stick together even on provisions we don�t like. We are a long way from home in getting this through the Senate.�

    USCIS used to have a lot of difficulty raising fees and would only get increases approved every few years. They now raise their fees frequently and have just announced their intentions to do so again. In the past, they blamed poor service on the lack of resources and promised - many times - that more money would translate in to better results. I once supported this view. But no longer. USCIS has received massive resource increases over the last several years and expanded the number of examiners greatly. Yet if you talk to seasoned immigration lawyers, there is more of...
