She can't work and you can't apply for work permit. You need to wait for the I-130 approval. Then AFTER you become a U.S. Citizen, she will be able to apply for I-485 Adjustment of Status and only at that time you will be able to apply for work permit. By the way. If the I130 is approved and she goes out of country and then tries to re-enter the U.S. on a B-2 visa, she may be denied entry based on Immigrant Intent, for which B1/B2 visa does not allow. Do some research.

i've been in the US on a f-1 visa since 2006. i am getting my masters at the moment. i am planning on getting married to my girlfriend who is a US citizen. i have been with her for the past 2 years and am dearly in love with her. we plan on getting married and i was wondering if i get married to her, can i apply for a green card right away or do i have to wait for a while before i can apply for a green card. she is also a student getting her bachelors.
my second question is that if i can apply for a green card then could i take a semester off and return to studying next semester or would that be a problem since i am on an F-1 visa.
i would appreciate it if i could get an answer soon so that i could take the semester off.

Hello
My friend is in USA on F1 visa and her wife and daughter denined visa twice with reason that my friend is studying here not working.
Even he is not offering sponsership to her wife and kids. His in laws are sponsering both of them. Now he wants to invite them on his graduation day. Can he get a letter from local senator with F1 visa status ? or is that only for people who pays taxes . ( H1b or l1b ) ?
Please advise.

don't think their is a set time required. I know people that left their employer the day after gc arrived, know people that left 6 months after their approval and some that have worked for their employer even after receiving their green card for over 4 years. hope this helps

How about this ? Lets say your consulting firm is ready to file your I-485 upon lots of restriction such as two year agreement and to spend around 10 gran.
While the big firm who has filed the PERM and waiting for the approval. In this case, can we do both the cases to see which is better upon the current situation.
This will help few of our folks and your thoughts are always appreciated.

My H1b 6 years time will expire on March 24th, 2011. One of my previous employer (eData experts) based out of PA had filed for my PERM labor in 12/12/1007.
But unfortunately due to their negligence it was denied and I was only told about only after 3 months. I currently work for another employer and they have not started my GC processing yet. I don't want to work for this new company because of lot of work pressure which is affecting my work life balance. Can someone out there please suggest me the options to stay in this country. This is very urgent. Your suggestions are really valuable for me. Appreciate your time.

I need to renew my H1 for the 9th year and was wondering if I need to pay the ACWIA fee of $1500. It seems employers who are filing for a 2nd extension are exempt from paying. Does it apply also to cases beyond the 2nd extension?

I had my tests done on Monday, X-Ray on Wednesday and my paperwork is ready today (Friday). All in all, it took about a week. Don't know about other doctors....this is in Milwaukee, WI.
