    is it possible and advisable to convert H1 B to H4 and go on searching for job and if find a job then coming back to H1? Are there any risks in this process? if so can some one explain me in detail?

    I am currently on H1 but planning to go on H4 due to current economic scenario.
    I am planning to go to India due to some family reason and planning to get COS from H1 to H4 in India.
    I have my salary slips and my husband has also maintained his status throughout.
    Has anyone heard any horror stories about H4 stamping cases getting denied.

    What documents they ask for when you go for COS from H1 to H4. Besides salary slips can they ask for my W-2's or they need my husband's W-2's only

    Hello All,

    I've been reading a lot on these forums about guys asking where to send 485 applications to. While my I-140 got approved from Texas center (originally filed at Nebraska center) , my lawyer still sent my 485 application to Nebraska center. I think, he has made a correct decision since, 485 form mentions that all employment based applications should be sent to Nebraska center. Please correct me If I am mistaken.

    Secondly, the application fee can be in the form of personal check made payable to USCIS or Department of Homeland security. I've made checks payable to USCIS - does any one know if the check has to say "USCIS" or should it say "United States Citizenship and Immigration Services"? I would think just "USCIS" would suffice.

    Any light shed on these two points would be greatly appreciated...

    All,

    IV needs money for rally.

    Lets pledge to contrbute right after you get recpits.
    We all are skilled immigrations with high billing rates per hour.
    Think about how many hours you have spent tracking receipts,

    Could please update your profile.
    And regarding problems at POE... its not totally true but at the same time you cannot
    rule out totally also.
    so basically keep all the required documents like your employer letter... and
    if possible your client letter showing you have job when you come back and
    also your recent paystubs.

    Gurus,

    I am moving 60 miles from where I live now. I am planning to do following two things.

    1. File a Form AR-11
    2. Call this number (800) 375-5283 for pending I-485 and EAD renewal applications for self and spouse

    Do I need to update the address on approved AP/I-140/EAD or any other approved applications as well.

    Am I missing something :confused:

    Please advice....Thanks :)

    Hi all,

    Mine is Labor Substitution with EB2 India PD is April 2005 and with the same Employer since 5 years .

    6 months back my case was moved to New York (I am working in NY as a consultant ) regional center where I am working now.


    I have to move to NCarolina this month end for a new assignment. What should I do now?
    If I inform USCIS thru AR-11, how much time they take to transfer my case to new regional office? Worried if they take long time and dates retrogress before they transfer.
    How early can I apply AR-11 and how late I must inform them?

    Anybody with similar experiences? Pleas suggest me the due course of action.

But my name in all my certificates is in short form like ( S H V My Name). Will this cause any problem in future if I apply for H1B??

    I have two H1bs. I was working on first H1 till 02/2007 , i moved to second H1from 03/2007 . I am planning to go back to my first H1b which is valid till 03/2008.

    Is moving back and forth on these two valid H1 is possible? If so what steps i need to follow.

    Hi,
    My H1(second term) expires in December 2009. I was out of the US for more than a year and resumed my job in jun 09. My employer will be filing for H1 extension in October 09.
    I have an approved I-140.
    If my H1 extension gets rejected, will that affect my green card process ? If H1 extension gets rejected and if I switch to EAD, will the H1 rejection affect green card processing ?
    Please Help.

    FORGET ABOUT November's bipartisan promises of civility and cooperation in Congress. At the time they seemed overly optimistic. Nonetheless, it is hard to believe that relations could have deteriorated so far so fast -- both between the new Democratic majority and congressional Republicans and between Democratic lawmakers and President Bush.

    Thursday's late-night rumble on the House floor, when a vote was gaveled to what Democrats acknowledge was a premature close, epitomized the ugliness that has overtaken the entire legislative process. In the end, the 110th Congress headed for its August recess with civility in shreds and achievements sparse. Indeed, the only thing that might make August look pleasant is September, when lawmakers will return to resume the acrimonious debate over Iraq policy and confront the looming end of the fiscal year with spending bills unpassed and presidential vetoes in the offing.

    There have been scraps of good news from the first seven months. Lawmakers managed to see two of their priorities become law: an increase in the minimum wage and passage of the recommendations of the Sept. 11 commission. Another major achievement, a lobbying and ethics reform bill that will make important changes in the way Washington does business, is awaiting Mr. Bush's signature. Both chambers passed versions of a measure to extend the health insurance program for children in low-income families.

    But many other Democratic priorities -- and a big presidential one, immigration reform -- were snarled in the Senate. The 60-vote majority needed to overcome a filibuster proved to be as big an impediment for majority Democrats as the Democrats had made it when Republicans held power. The failure of immigration reform, of which there had been at least a hope of bipartisan achievement, was a particularly low note. Meanwhile, Democrats in both chambers chose to spend countless hours mired in a fruitless effort to compel an "end" to the war in Iraq.

    One of the most disappointing recent developments has been the administration's apparent decision, in the aftermath of the immigration bill's failure, that there was not much to be gained from working with this Congress -- and something to gained by taking it on. This new belligerence has manifested itself in a blizzard of veto threats -- Democrats counted up 31 between May 1 and Aug. 1 -- the most regrettable of which involves the children's health insurance bill.

    In the final hours before recess, it was hard to know which was more shameful: the administration's use of the looming vacation to bully Democrats into accepting its overbroad rewrite of the Foreign Intelligence Surveillance Act or Democrats' spinelessness in caving to this strong-arming.

    On the House side, a major disappointment was the failure of Democrats to live up to their pledge to treat the new Republican minority better than Democrats were treated when Republicans held power. Democrats promised a new, more open House, with adequate time for members to digest complex legislation and ample opportunity for the minority to offer amendments on the floor; instead, they, too, often used the same hardball tactics to muscle through legislation that Republicans had employed. That might have been understandable in the Democrats' "first 100 hours" that the new Congress was in session, but it is unfortunate that it persisted until the recess. That's no way to do business, and Democrats know it.

    I have a last pay check through an Employer A of August 1, 2008. Earlier before leaving Employer A I filed a H1 transfer to a new employer B and that got approved by USCIS but I didn't start working with Employer B. Now I am getting a new offer from Employer C which is better than Employer B. Attorney of Employer C says that he can file for a transfer through company A as the pay check is less than two weeks.

    Now my problem is I not sure whether my transfer from A to C would be successfull or not?


    Another thing I have not informed Employer B that I will not be joining him, Do I have to pay him all the H1 transfer fees?

    There are basically two big camps in the immigration reform debate and each has subsidiary interests that diverge in important respects from the bigger grou[. There is the pro-immigration camp which generally favors immigration reform proposals introduced over the last few years. Within the pro-immigration camp, there is the labor left which is in favor of legalization but balks at provisions that would provide temporary or permanent visas to workers that might come in the future. In the anti-immigration camp, there is the major group which opposes any form of legalization and is of mixed thinking on future worker provisions....

    On June 26, 2009, U.S. Citizenship and Immigration Services (USCIS) announced that the current edition of the Employment Eligibility Verification Form I-9 (Rev. 02/02/09) will continue to be valid for use beyond June 30, 2009. USCIS has requested that the Office of Management and Budget (OMB) approve the continued use of the current version of Form I-9. Once the extension request is approved, USCIS will update Form I-9. At that time, employers will be able to use either the Form I-9 with the new revision date or the Form I-9 with the 02/02/09 revision date.
