Nina Bernstein, one of the country's best immigration reporters, has a front page story in this morning's Times regarding 30 survivors of the January Haiti earthquake who were airlifted by Marines to the United States and are now sitting in detentions centers in Florida. My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!

I have a offer from an employer and they say that they will be able to provide documentation for GC processing but will not be able to sponsor. What does that mean? Can i hire attorney for my GC processing(EB2) and pay the expenses by myself? What else would be required from the employer?

The questions is, if i have an approved I-140 from Company A and I switch over to Company B, then would i be able to file my 485 based on 140 related to Company A when my PD for Labor (company A) becomes current.

1. Does it really matter what date the 485 application was filed, if it was filed within the specified time-period ?
I mean, will it matter if someone applied for 485 on July 30th or August 17th, other than trying for an EAD and AP earlier ?
2. Is there a benefit of applying early in the timeframe, in getting an approved 485 ?
Please respond at your convenience.

What documents do they need to furnish ?
As I understand there are a lot of ppl who come to the US who do not have kids/relatives here, what do they have to show if they are just coming to the US for a Visit not work related ?

Make sure that they show enough funds to survive and not become a liability.

If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

When one applies for AP in Multiple entry category they will be given 2 AP dox. lets say if one has used both on travelling like both has stamp of POE can they reuse the same for future travel with in the one year period of validity ?

Hi all,
I received an I-485 RFE for me and my spouse on July 28th. For the primary applicant it was Employment verification letter (currently dated letter from employer describing duties,position and salary info) and for my wife it was about proof of bonafide marriage.
My attorney replied to RFE on Aug 6th with necessary evidence and EVL.
Online status for both of us changed today Aug 10th from RFE SENT to RESPONSE TO RFE RECEIVED AND CASE PROCESSING RESUMED.
Hope this info is helpful in estimating time for people in similar situations.

I did it through an attorney and captured about 5 months.
They did a photo copy of my entry/exit dates in the Passport and copy of all my previous I94 cards. Along with that they sent in a Letter asking USCIS for the recapture.
It was a H1 transfer and recapture at the same time. I got approved for 17 months ( 1 Year + 5months recapture). at that time, I was over 6 years without I140 approved.

I am working for company A on H1 which is valid until November 2010. I would like to work for Company B on EAD, since company B would not do H1
To be on the safer side, I would to like have another H1 from company C, so that if anything happens with I-485, I can join company C on the H1.
Is this possible? Do I have to travel out of country in order to work for company C on H1?

Hi,
Currently i am working as full time employee on H1B, receiving W2. I have EAD valid until Oct 2010.
Can i use EAD to work part time and receive 1099 as income statement? If i use EAD / 1099 will this cause an issue for I-485 approval (AOS is pending) ?

I am in EB3 with Labor and I-140 approved, I-485 in process, and have EAD/AP. If I switch employers and take up a new role (different from the one GC application is based on), and not file AC21 (because that's not applicable when switching job roles), should I continue to stay mum hoping to not receive a RFE for EVL and get a GC by mail silently someday or request new employer to file a new EB2 perm and preserve the old (2002) priority date?
In case I go with the former, and end up receiving a RFE, can I explain my true status and go for the latter at that point? What are the chances that one will receive an RFE for Employment verification for a case that has been pending for 7 years, and I-485 pending for 3 years?
Any personal experiences and guidance will greatly help me. Thank you!

Hello all. This is a basic question: Are all 501(c) employers exempt from the H1 cap? I have heard and read so much about some non-profits being exempt from the H1 cap, but no one could tell me with certainty which ones.
